Pablosky offers you an online shopping service that allows you to purchase some of the items available in our stores from your mobile, tablet, and/or computer. You can also enjoy exclusive promotions, gifts, and offers.

Below, we invite you to review the general terms and conditions of sale that regulate the purchase of Pablosky products through this website. By using this website, you agree to these general terms of sale. However, if you have any questions about them, you can contact our Customer Service.

Contract

1.1. Service Availability

By placing an order on Pablosky.com, you confirm that you are over 18 years of age.

The products offered are distributed in Spain (Peninsula and Balearic Islands), Portugal, Ireland, France, Germany, Austria, Belgium, Bulgaria, Cyprus, Croatia, Denmark, Slovakia, Slovenia, Estonia, Finland, Greece, Hungary, Italy, Latvia, Lithuania, Luxembourg, the Netherlands, Poland, the Czech Republic, Romania, and Sweden.

Users can only benefit from the online shopping service of this website when the shipping address of the order is located in one of the countries or territories enabled in our Country Selector Menu.

The items offered on this website are a selection of Pablosky products and meet the same quality and guarantee requirements as those offered in Pablosky stores.

*Pablosky has made efforts to display the colors of the products as close to reality as possible. However, the color of the shoes displayed on the screen may be subject to variations depending on the quality of the screen of your mobile, tablet, and/or computer. Therefore, Pablosky cannot guarantee that the colors displayed on your monitor will accurately reflect reality.

Special offers, promotions, or discounts will be valid until the indicated date or while stocks last.

Likewise, Pablosky makes every effort to ensure that the information contained on the website is complete, truthful, and correct. If any data error exists, Pablosky will immediately correct it.

The legal guarantee of the products offered by Pablosky is established in Royal Decree Law 7/2021, of April 28, approving the consolidated text of the General Law for the Defense of Consumers and Users.

Pablosky will be responsible for any product defects that occur within three years from delivery.

 

1.3. Purchase Procedure

The items to be purchased must be selected and added to the shopping bag by clicking on the corresponding icon.

The shopping bag will contain the reference of the selected item, its name, size, chosen color, and price, in the corresponding currency (taxes included). The stated price does not include transportation, which will vary depending on the selected shipping address and method.

To make the purchase, the user's personal data will be required, which will be added to our database to process the order and facilitate future purchases through the website. The personal data provided by users will be treated according to our Privacy Policy. Users can access their personal data and order information at any time. Pablosky reminds users that personal data must be provided accurately to avoid confusion or issues with shipping the purchased item(s). Additionally, if requested by the user, they will receive information and publications about Pablosky via email and/or SMS.

Once the purchase order has been completed, and before confirming it, a summary of the order will be presented to the user, identifying the purchased item, its total price (including transport and taxes), with a breakdown of each concept, and the shipping details of the order. The user must confirm the order by clicking on the button labeled 'Confirm Payment'.

Purchases can be paid for by credit or debit card (Visa, Visa Electron, and MasterCard) and/or through PayPal. Other payment methods not specifically listed on the Order Confirmation page will not be accepted. For credit or debit card payments, the charge will be made online, in real-time, through the payment gateway of the corresponding financial institution, once the user's provided information has been verified as correct.

Once the transaction has been confirmed, the order number will be displayed on the website so that the user can track the order at any time from their mobile, tablet, and/or computer.

An automatic confirmation email will also be sent to the user with a description of the order and the personal details provided. If this email is not received, it may be due to a temporary communication issue on the network or a mistake in the email address provided. In both cases, Pablosky recommends that the user contacts Customer Service. Similarly, the user will be notified by email once the product has been shipped.

1.4. Product Availability

All orders are subject to product availability. If, when issuing the order, we detect that one of the products included is not in stock, Pablosky will attempt to locate the item. If this is not possible, the customer will be immediately notified. Additionally, the amount charged for the item not sent will be refunded to the customer within the following days, using the same payment method.

1.5. Right to Decline an Order

Pablosky may cancel or refuse any confirmed order for the following reasons:

In case of a technical error and/or typographical error in the prices or other product details on the website at the time the order was placed.

Due to lack of availability as described in section 1.4.

If security systems indicate that the order may be fraudulent.

If there are reasons to believe the user is a minor.

If Pablosky cannot deliver the order to the provided address.

Pablosky will fully refund any amounts that have been paid.

 

Price and Payment

2.1. Payment and Currency

The prices on this website are displayed in Euros.

Pablosky gives users the option to select the destination country at the start of their purchase so that they can see the product prices with the corresponding taxes included. If the customer changes the delivery address later and the destination country is modified, the prices displayed in the final order summary may vary.

2.2. Value Added Tax (VAT)

In accordance with the VAT law, Pablosky is obliged to apply this tax, at the current rate, to all products delivered in Spain (except the Canary Islands, Ceuta, and Melilla) as well as in other countries within the European Union.

For deliveries made to the Canary Islands, Ceuta, and Melilla, the applicable taxes and duties will apply according to the current regulations in each of these territories.

2.3. Payment Methods

Pablosky will only accept payments made via credit or debit card (Visa, Visa Electron, MasterCard) and/or through PayPal.

Credit or Debit Card Payment

Pablosky accepts payment for purchases made on its website using the following credit or debit cards: Visa, Visa Electron, and MasterCard.

If the payment method chosen by the user is credit or debit card, the charge will be made online, in real-time, through the payment gateway of the corresponding financial institution, once it has been verified that the information provided by the user is correct.

Payment with PayPal

Pablosky accepts processing payments through the PayPal system.

Customers can link their PayPal account with Pablosky's. This way, it will not be necessary to enter data with each purchase made through this system.

2.4. Purchase Limit

Pablosky does not allow the purchase of Pablosky products for resale. In this regard, purchases exceeding 500 euros or containing more than 15 items cannot be made. Customers interested in making purchases above this amount or quantity for purposes other than resale must contact Customer Service, where they will be informed about the various options for making the desired purchase.

The delivery time and shipping costs will vary depending on the type of shipping.

Home deliveries are free for any order over €35 and cost €3.95 for lower amounts. Free returns.

You can receive it at the address of your choice (home, work, etc.).

Returns 

You have 14 calendar days from the date of delivery to request your return.

The cost of the return varies depending on the destination country of the order. We will deduct the amount at the time of issuing the refund. Here you can check the different return costs:

For orders shipped to Spain, we accept size exchanges for a received product, provided that the new size has the same price as the originally purchased one.

Steps to follow:

  1. Request the return or size exchange at cambios.pablosky.com. You will receive a confirmation email immediately.
  2. Package. Pack the shoes in the original packaging.
  3. Deliver package. From your home, hand your package to the carrier who will come to the specified address. Remember that you do not need to print any shipping label; the messenger will bring it printed. In the coming days, you will receive the amount of your return in the same way you made your purchase and an email informing you of the refund.

We remind you that we can only refund products returned correctly. If your return does not meet the described conditions, Pablosky will not be able to issue the refund, and you may request the return of your package, assuming, in that case, the new shipping costs from the warehouses.

 

Right of withdrawal

The customer has the right to withdraw from this contract within 14 calendar days without the need for justification.

The withdrawal period will expire 14 calendar days from the day the customer acquires the goods. The right of withdrawal cannot be exercised in the case of used products.

To exercise the right of withdrawal, it is necessary to notify us of the decision to withdraw from the contract through an unequivocal statement (for example, a letter sent by postal mail, fax, or email):

We remind you not to provide your card details via email, fax, or social media.

To comply with the withdrawal period, it is sufficient that the communication regarding the exercise of this right is sent before the corresponding period expires.


Consequences of withdrawal

In case of withdrawal, we will refund the customer all payments received after the purchase, including delivery costs (with the exception of additional costs resulting from the customer's choice of a delivery method other than the least expensive standard delivery method we offer) without any undue delay and, in any case, at the latest 14 calendar days from the date we are informed of the decision to withdraw from this contract. We will proceed to make this refund using the same payment method used by the customer for the initial transaction, unless the customer has expressly provided otherwise. In any case, there will be no cost incurred as a result of the refund.

We may withhold the refund until we have received the goods or until the customer has provided proof of their return, whichever condition is fulfilled first.

The customer must return or hand over the goods to us without any undue delay and, in any case, no later than 14 calendar days from the date they communicate their decision to withdraw from the contract. The deadline will be considered met if the goods are returned before that period ends.

To proceed with the return of the goods, the customer may use the services that Pablosky makes available: home collection.

Refunds

Once the product(s) are received, Pablosky will verify that they are in good condition and will proceed to refund the amount using the same payment method used for the purchase in the case of return.

The refund period may range from 3 to 12 business days from when the return is received at Pablosky's warehouse. Once the condition of the returned items is verified, the customer will be informed via email.

In the event of exercising the right of withdrawal from the order, the maximum period for the return of the amount paid by the consumer for the products will be 14 calendar days from the withdrawal.

The refund for returned items will always be made in the same payment method used for the purchase.

If Pablosky mistakenly sent a different item than requested or if the quality of the sent item is not adequate, Pablosky, once the error or defect is verified, will refund the amount of the returned item and the shipping costs.

 

Registration

The data provided by customers during registration will be used by Pablosky solely to process orders and facilitate navigation and the purchase process on the Website. Additionally, if expressly accepted by the customer, Pablosky will inform them via e-mail about new collections and exclusive offers. 

Pablosky guarantees that the data provided by customers will not be shared with third parties or companies outside of Pablosky.

The personal data provided by users will be processed according to Organic Law 15/1995 of December 13 on the Protection of Personal Data. For more information, we recommend consulting our Privacy Policy.

The customer may exercise their rights of access, rectification, cancellation, or opposition regarding the provided data at any time and through the My Account section of our website, via email, or by mail to the following address:

Comments, suggestions, complaints, and claims

Your comments and suggestions are welcome. We ask that you send us such comments and suggestions, as well as any queries, complaints, or claims, through our previously indicated contact channels.

Your complaints and claims to our customer service will be addressed as soon as possible.

If you as a consumer believe that your rights have been violated, you can direct your complaints to us via the email address  hola@pablosky.com in order to request an extrajudicial solution to disputes.

In this sense, if the acquisition between you and us was made online through our website, in accordance with EU Regulation No. 524/2013, we inform you that you have the right to request an extrajudicial resolution of consumer disputes with us accessible through the Internet address  http://ec.europa.eu/consumers/odr/.

Special Conditions for Customized Products

Customized products are made specifically for you and cannot be returned unless there is a manufacturing defect. In this case, please contact our Customer Service.

 Image Use:

We cannot make customizations that include images protected by copyright, such as trademarks, franchises, or any other design subject to third-party intellectual property.

If it is detected that the uploaded image infringes these terms, your order will be canceled and the product amount refunded using the payment method used.

Please verify that the images you want to use in your customization comply with intellectual property laws.
