Pablosky Tribe Gallery Terms and Conditions

These Terms and Conditions regulate the access, browsing, and use of this Gallery. Through the Pablosky brand, Calzados Pablo, S.L.U. with tax identification number B45007671, offers users the option to provide images, comments, videos, and other content using the corresponding social media sections, to interact with the online sales platform for Pablosky brand products, www.pablosky.com.

You must read and accept these Terms and Conditions before using the Services. If you do not agree with the Terms and Conditions, you should not use the Services.

The use of the Services will not establish any type of contractual relationship between you and Pablosky.

1. Posting photos in the Gallery.

All photos posted on social media that mention @pabloskyshoes or include the hashtag #pablosky #pabloskyshoes #pabloskytribu may be selected by Pablosky to appear on our website www.pablosky.com.

Your profiles must be public for us to see your photo. Otherwise, your photo will not be visible and you will not be able to be selected. If you are interested and consent to the publication, you will use the hashtag #yesPablosky, which will require you to first read and accept these Terms and Conditions.

Photos that have not expressly accepted these Conditions will not be published, so, if you do not agree, you should not include the hashtag #yesPablosky.

2. Photo selection criteria and visual identity manual.

Pablosky will select photographs that highlight the brand's products and that best adapt to the brand's image and spirit. Photos must clearly show at least one Pablosky product. Photos will be selected based on their size and quality, as well as their appearance. Under no circumstances may photos violate public order, good customs, or current legislation.

We prohibit the publication of photos that may be considered abusive, violent, dangerous, threatening, defamatory, offensive, hate-motivated, discriminatory, profane, or pornographic.

Pablosky is not obliged to use the photos, even if they comply with all the terms of these General Conditions.

If your photo is selected on a social network, you will receive a comment from the official Pablosky page. Respond using the hashtag #yesPablosky to give your permission and accept our current General Conditions.

Pablosky reserves the right to add or delete text, edit images, and reject, suspend, cancel, or remove the publication of the transferred content.

3. Assignment of content rights.

The assignment of content to Pablosky is free and revocable, and implies that you accept its publication on the website www.pablosky.com, social media, and publications such as newsletters and other commercial and/or advertising publications of Pablosky. The publication of the content will not establish any type of contractual relationship between you and Pablosky.

If you give your consent to Pablosky, you certify that you hold the copyright to the published content, as well as the image rights permissions of third parties appearing therein.

By accepting these Terms and Conditions, you declare that you are over 18 years of age and assume full responsibility for this declaration. In case of being a minor, you certify that you have previously obtained the express consent of your legal representatives (parents/legal guardians). Pablosky may use and disseminate the assigned images for the stated purposes as long as such uses do not violate your right to honor, personal and family privacy, and self-image.

4. Data protection.

In accordance with the provisions of current regulations on data protection (EU Regulation 679/2016 General Data Protection Regulation and Organic Law 3/2018 on Personal Data Protection), and by Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce, we inform you:

Purposes: To manage the publication of content (photographs and/or videos) from social media users for its publication and public communication through our website www.pablosky.com, social media, and publications such as newsletters and other commercial and/or advertising publications by Pablosky.

Legitimacy: The consent of the adult user, and the express consent of the parents/legal guardians in the case of a minor user.

Recipients: No international data transfers are foreseen. Data will not be transferred to third parties, except for legal obligation or authorization.

Rights: You can revoke this authorization at any time, as well as exercise your data protection rights of access, rectification, erasure, data portability, and opposition, as well as request the limitation of processing by sending an email to hola@pablosky.com.
